Honeycat Messaging Privacy Policy

This Messaging Privacy Policy explains how oxoxmoon inc, doing business as Honeycat (“Honeycat,” “we,” “us,” or “our”), collects, uses, discloses, and retains personal information when you enroll in or interact with a text messaging program that we make available (the “Messaging Program”). It supplements our Privacy Policy. If this Messaging Privacy Policy and our Privacy Policy differ specifically regarding the Messaging Program, this Messaging Privacy Policy applies to the Messaging Program.

Information We Collect

When you enroll in or interact with the Messaging Program, we may collect:

  • your mobile telephone number;
  • the date, time, source, method, and scope of enrollment;
  • the disclosure presented when you enrolled and the affirmative action used to enroll;
  • records of consent, withdrawal, opt-out, and help requests;
  • message content and communications metadata, including message dates and times;
  • delivery status, carrier, device, browser, IP address, and related technical information when collected;
  • information you voluntarily provide when requesting assistance; and
  • customer-account, order, cart, checkout, or store-interaction information when reasonably necessary to provide a message you requested or validly permitted.

Providing a telephone number solely for an order, delivery, account, customer-service request, or another non-marketing purpose does not by itself enroll you in marketing text messages.

Our website also uses cookies and similar technologies as described in our Privacy Policy and Cookie Policy. Information from those technologies is used in connection with the Messaging Program only as permitted by applicable law, the scope of your enrollment, and the privacy choices available to you.

Sources of Information

We may obtain Messaging Program information directly from you; from our ecommerce, checkout, messaging, and customer-service systems; from service providers that operate or support the Messaging Program; from mobile carriers and delivery partners; and from your interactions with Honeycat’s store, messages, and customer-service channels.

How We Use Information

We may use Messaging Program information to:

  • send messages within the scope of the consent or request you provided;
  • administer enrollment and maintain consent records;
  • process opt-out and help requests;
  • maintain suppression and do-not-contact records;
  • authenticate or verify enrollment where appropriate;
  • deliver, secure, troubleshoot, analyze, and improve the Messaging Program;
  • personalize messages only when permitted and consistent with the disclosure presented at enrollment;
  • prevent fraud, misuse, and security incidents;
  • comply with applicable law, carrier requirements, and legal process; and
  • protect the rights, safety, and security of Honeycat, our customers, and others.

Legal Bases Where Applicable

Where applicable law requires a legal basis for processing, we rely on consent to send marketing text messages. We may also process information as necessary to provide messages or services you specifically request, comply with legal obligations, maintain consent and suppression records, establish or defend legal rights, and secure and administer the Messaging Program where our legitimate interests are not overridden by your rights.

You may withdraw consent to marketing text messages at any time. Withdrawal does not affect processing that lawfully occurred before the withdrawal.

How We Disclose Information

We may disclose Messaging Program information to Shopify and other ecommerce or messaging platform providers, mobile carriers, delivery partners, security and fraud-prevention providers, customer-service providers, professional advisers, and other service providers that help us operate the Messaging Program.

We may also disclose information when required by law, court order, subpoena, or other valid legal process; to investigate or prevent fraud, misuse, security threats, or unlawful activity; to protect rights, property, or safety; or in connection with a merger, financing, reorganization, sale, or transfer of all or part of our business, subject to applicable law.

Mobile Information and Marketing Disclosures

No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with or disclosed to any third party, excluding the contracted service providers and carriers that help us operate the Messaging Program, who may use it only to provide services to Honeycat and not for their own marketing purposes. We may also disclose such information as required by law. We do not share mobile information for cross-context behavioral advertising.

Retention

We retain Messaging Program information only for as long as reasonably necessary for the purposes described in this policy, including to operate the program, document consent and opt-out activity, maintain suppression and do-not-contact records, resolve disputes, protect security, and satisfy legal, tax, accounting, and compliance obligations.

Retention periods may vary according to the type of information and applicable requirements. We retain suppression and do-not-contact information for at least five years, or longer where required, so that we can continue honoring opt-out requests.

Your Choices and Privacy Rights

You may stop marketing text messages using any of the opt-out methods described in the Messaging Terms below.

Depending on where you live and subject to applicable exceptions, you may also have rights to request access to, correction of, or deletion of personal information; receive a portable copy; restrict or object to processing; withdraw consent; or appeal a decision concerning a privacy request.

Security

We use reasonable administrative, technical, and organizational safeguards designed to protect Messaging Program information. No transmission or storage system is completely secure, and we cannot guarantee absolute security.

Changes to This Messaging Privacy Policy

We may update this Messaging Privacy Policy from time to time. We will post the updated version on this page, revise the “Last Updated” date, and provide any additional notice required by applicable law.

Honeycat Messaging Terms

These Messaging Terms govern any text messaging program that Honeycat makes available. They supplement our Terms of Service and Privacy Policy.

Program and Consent

If Honeycat makes a Messaging Program available and you voluntarily enroll through the affirmative action displayed at an enrollment point, you agree to receive recurring automated marketing text messages from Honeycat at the mobile number you provide. Marketing messages may concern promotions, offers, products, collections, and brand news.

If the disclosure presented when you enroll expressly identifies cart or checkout reminders, personalized messages, or another message category, that category is included only within the scope of that disclosure. We will not retroactively expand the scope of your consent.

Consent to receive marketing text messages is not a condition of purchasing any goods or services. Message frequency varies. Message and data rates may apply.

Each marketing message will identify Honeycat and provide an easy opt-out method as required by applicable law.

Providing a telephone number for an order, delivery, customer-service request, account, or other non-marketing purpose does not by itself enroll you in marketing text messages. Transactional and service messages are separate from marketing messages and do not establish consent to marketing.

Enrollment Disclosure

The disclosure presented at the enrollment point, together with your affirmative enrollment action and the associated consent record, governs the scope of your consent. The disclosure will identify Honeycat, the types of messages offered, how to opt out or request help, whether message frequency varies, and that message and data rates may apply. Consent to receive marketing text messages is not a condition of purchase.

Enrollment and Consent Records

Consent applies to the mobile number, message types, and Honeycat enrollment point identified when you enroll. The disclosure shown at that enrollment point and the associated consent record are part of these Messaging Terms.

We or our service providers may retain records showing the date, time, source, method, and scope of enrollment; the disclosure displayed; the mobile number provided; the affirmative action taken; and later consent, help, and opt-out activity.

Opting Out

You may revoke consent and opt out of marketing text messages at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to a message from us. Where a message includes an unsubscribe link, you may also use that link. If a sender does not support replies, the message will state that replies are unavailable and provide a working alternative opt-out method.

You may also opt out by using any other words or reasonable method that clearly communicates a request to stop, including by emailing hello@honeycat.us. We will honor a valid opt-out request as soon as practicable and no later than ten business days after receipt, or sooner when required by applicable law. No particular wording or method is required if your request clearly communicates that you want the messages to stop.

We may send one non-marketing message confirming that we processed your opt-out. After you opt out, we will stop all recurring Messaging Program texts unless you later provide new valid consent. Only the one permitted confirmation and genuinely consumer-requested or legally exempt non-marketing messages may follow. We will honor any applicable opt-out right for those messages.

Help and Customer Care

Where reply messaging is supported, reply HELP to a message from us for assistance. If replies are unavailable, the message will provide another help method. You may always contact hello@honeycat.us for help or to communicate an opt-out request.

Messaging Hours

Honeycat and its service providers intend to send marketing messages only during hours permitted by applicable federal and state law, based on information reasonably available to us. Network delays or other technical conditions outside our control may affect actual delivery time.

Internal Do-Not-Contact Policy

Honeycat maintains internal do-not-contact procedures and suppression records for the Messaging Program. We do not knowingly send marketing text messages to a mobile number after a valid opt-out request has been processed. We train appropriate personnel and configure our messaging tools to recognize and honor reasonable opt-out requests. Requests may be made using the methods described in these Messaging Terms.

Mobile Number Responsibility

You represent that you are the subscriber or customary user of the mobile number you provide and are authorized to consent to messages at that number. You must not enroll a number belonging to another person without that person’s authorization.

If you change, deactivate, surrender, or transfer the number, please notify us at hello@honeycat.us so that we can update our records.

Eligibility

You may enroll only if you are at least 18 years old and have reached the age of majority in your jurisdiction, and you have the legal capacity to agree to these Messaging Terms.

Delivery, Carriers, and Availability

The Messaging Program might not be available on every device, carrier, or in every location. Delivery depends on mobile-carrier and network availability and is not guaranteed.

Carriers are not responsible for delayed or undelivered messages. To the extent permitted by applicable law, Honeycat and its service providers are not responsible for delays or delivery failures caused by carriers, networks, devices, inaccurate contact information, or circumstances outside their reasonable control.

Changes or Discontinuation

We may modify, suspend, or discontinue the Messaging Program or update these Messaging Terms. We will post an updated version on this page, revise the “Last Updated” date, and provide any additional notice required by applicable law.

A change to these Messaging Terms will not retroactively expand the scope of consent you previously provided.

Other Honeycat Terms and Non-Waivable Rights

These Messaging Terms supplement our Terms of Service. The governing-law and dispute-resolution provisions of the Terms of Service, including Section 21 (Dispute Resolution; Arbitration; Class Waiver), apply to the Messaging Program to the extent permitted by applicable law.

Nothing in these Messaging Terms limits a non-waivable consumer right or remedy.

Consumers in the EEA and United Kingdom retain access to the courts and protections made available by applicable law.
